After talking of the destruction that would come of e forced priestcraft, Alma goes on to remind Nehor of his crime based upon the written and acknowledged ?law left by Mosiah. I don’t think that Nehor could attempt to argue that killing Gideon was right. Likely he argued that this was a special circumstance and that he was not responsible for his crime of passion. Alma calmly judged that Nehor’s action was inexcusable and that he would be condemned to die in accordance to the law for he crime which he had commited.
